CNN —The United Nations’ top court struck down a demand by Nicaragua that Germany immediately halt its arms exports to Israel on Tuesday, saying it cannot issue emergency measures against Berlin under the current circumstances. However, the court also rejected Germany’s demand to strike the lawsuit from its list, meaning the case will now move on. The ruling on Tuesday only concerned whether or not Berlin should be ordered to immediately stop selling arms to Israel. Germany “welcomed the ICJ ruling” according to a statement posted by the German Foreign Ministry on X shortly after the announcement. The ICJ is still considering whether Israel is guilty of violating the Genocide Convention, a legal process that could take years.

CNN —A showdown between Mexico and Ecuador begins on Tuesday at the International Court of Justice (ICJ), the culmination of weeks of recrimination over an incident that saw Ecuadorian forces raid Mexico’s embassy in Quito in April, to arrest a former vice president who had been seeking asylum. Mexico is suing Ecuador at the world court over the armed raid, saying it violated the Vienna Convention, a United Nations treaty on diplomatic relations. The incident drew widespread international condemnation, but Ecuador’s President Daniel Noboa remains unrepentant, telling CNN affiliate SBS news that he does not regret how Glas was arrested. Meanwhile, Ecuador filed a lawsuit of its own at the ICJ against Mexico over its decision to grant asylum to Glas. The diplomatic spat has seen a host of Latin American leaders across the political spectrum rally around Mexico, and several nations sever ties with Ecuador.

Berlin CNN —Germany has hit back at allegations by Nicaragua that it has been “facilitating genocide” in Gaza, telling an international court on Tuesday that history undergirds German support for Israel. But Germany argued Tuesday that because the “bedrock” of Nicaragua’s case was aimed at Israel and its “alleged violations of international law by Israel,” the ICJ did not have jurisdiction. British lawyer Samuel Wordsworth, who advocated on behalf of Berlin, said the case against Germany is “entirely dependent” upon a “prior finding of breach” of international law by Israel in Gaza. The ICJ is hearing a separate case brought against Israel by South Africa, but has not ruled on whether Israel has breached international law in Gaza. The international court will now consider whether to order the emergency measures requested by Nicaragua.

Fifty-two countries will participate in arguments at The Hague over the six-day hearing – more than any other case heard by the court in its history. Israel captured the West Bank, East Jerusalem and Gaza in the 1967 Six-Day War. Israel today has full administrative and security control over 60% of the West Bank area while the PA has nominal control over Palestinian population centers. There are an estimated 700,000 Israeli settlers illegally living in the West Bank. The ICJ's six days of hearings starting on Monday come after the U.N. General Assembly asked the court in 2022 for an advisory, or non-binding, opinion on the occupation. It is the second time the U.N. General Assembly has asked the ICJ, also known as the World Court, for an advisory opinion related to the occupied Palestinian territory. “The International Court of Justice is set for the first time to broadly consider the legal consequences of Israel’s nearly six-decades-long occupation and mistreatment of the Palestinian people,” said Clive Baldwin, senior legal adviser at Human Rights Watch. While Israel has filed a written statement with the court, it has not asked to participate in the hearings.

South Africa on Tuesday asked The International Court of Justice (ICJ) to consider whether Israel's plan to extend its offensive in Gaza into the city of Rafah requires additional emergency measures to protect Palestinians' rights. "South Africa continues to represent the interests of the Hamas terrorist organization and is trying to deny Israel the fundamental right to defend itself and its citizens," said Foreign Ministry spokesperson Lior Haiat. The ICJ last month ordered Israel to take all measures within its power to prevent its troops from committing genocide against Palestinians in Gaza, in a case brought by South Africa. The court has not yet ruled on the core of the case brought by South Africa - whether genocide has occurred in Gaza.

CNN —Twelve Middle Eastern football associations have called for Israel’s national team to be banned over the war on Hamas in Gaza, in a letter seen by CNN. AMSTERDAM (Reuters) - Nicaragua has filed an application with the International Court of Justice (ICJ) to join South Africa in its genocide case against Israel, the ICJ, also known as the World Court, said on Thursday. The court said in a statement that Nicaragua considers that the conduct of Israel is in "violation of its obligations under the Genocide Convention". South Africa and Israel have been invited to furnish written observations on Nicaragua's application for permission to intervene as a party. Several other states have signalled they might want to intervene in the Gaza genocide case but none have formally done so before Nicaragua. Last month the World Court ordered Israel to prevent acts of genocide against Palestinians and do more to help civilians, although it stopped short of ordering a ceasefire as requested by South Africa.

Hong Kong/Tokyo CNN —One of Japan’s biggest trading firms, Itochu, has decided to end its partnership with a major Israeli defense company due to the war in Gaza. The sprawling conglomerate, best known outside Japan for its Family Mart chain of convenience stores, said its aviation unit will cut ties with Elbit Systems, which bills itself as Israel’s largest defense contractor, by the end of February. Itochu Aviation, Elbit Systems and Nippon Aircraft Supply signed a cooperation agreement in March 2023, months before war broke out between Israel and Gaza. Itochu, which reported revenues of $104 billion in 2023, has faced small-scale, student-led protests in Tokyo against its partnership with Elbit since January. Its Family Mart chain has also been the target of calls for boycotts in Muslim-majority Malaysia over the agreement.

CNN —The United Nations’ top court on Friday said that it will move forward with a case brought by Ukraine over Russia’s justification of its February 2022 invasion. Kyiv had asked the court to declare it did not commit genocide in eastern Ukraine - a claim made by Russia as a pretext for launching its attack. Ukraine filed the the case to the International Court of Justice (ICJ) just days after Russia launched its invasion on February 24, 2022, citing Moscow’s invocation of the Genocide Convention to justify its assault. During hearings in September last year, lawyers representing Moscow urged judges to throw out the entire case. Ukraine is asking the court to rule “that there is no credible evidence that Ukraine is responsible for committing genocide in violation of the Genocide Convention in the Donetsk and Luhansk oblasts of Ukraine.”However, the court said it did not have the jurisdiction to rule on all submissions put forward by Ukraine, including the claim Russia’s invasion itself violated the Genocide Convention and that Russia’s recognition os separatist territories in eastern Ukraine also breached the convention.

CNN —More than 800 officials from the United States and Europe have signed a scathing criticism of Western policy towards Israel and Gaza, accusing their governments of possible complicity in war crimes. Among them are around 80 United States officials and diplomats, a source told CNN. The official added that the ICJ’s decision to hear a genocide case lodged against Israel was validation for the authors’ concerns. Despite the letter not listing its authors, the US official told CNN many colleagues feared losing their jobs, and that the lower number of US signatories reflected stronger protections for official dissents in Europe. CNN has asked the U.S. State Department, the European Union, and the Dutch Foreign Ministry for a response to the statement.

The United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) assists Palestinians in Jordan, Lebanon, Syria and the West Bank, as well as in Gaza. Some $440 million of funding has been suspended, according to UNRWA, which has 13,000 staff in Gaza. The agency said the severe humanitarian needs of Palestinians in Gaza would likely deteriorate further if the funding is not restored. Israeli Prime Minister Benjamin Netanyahu on Wednesday called for UNRWA to be dismantled and replaced by other aid groups. Security Council resolution to demand an immediate humanitarian ceasefire between Israel and Hamas, a move that the United States - a council veto power - opposes because it says it would only benefit the Palestinian militants. It was not immediately known when or if Algeria's draft resolution could be put to a vote. A resolution needs at least nine votes in favor and no vetoes by the United States, Britain, France, China or Russia to be adopted. The U.S. and Israel oppose a ceasefire, believing it would only benefit Hamas. Earlier in December the 193-member U.N. General Assembly demanded a humanitarian ceasefire, with 153 states voting in favor of the move that had been vetoed by the United States in the Security Council days earlier.

The court rejected Ukraine’s requests to order reparations for both violations and only ordered Russia to comply with the treaties. Ukraine’s representative Anton Korynevych stressed the judgment was important for Kyiv because it did establish Russia violated international law. Ukraine had filed the lawsuit at the ICJ, also known as the World Court, in 2017, accusing Russia of violating an anti-terrorism treaty by funding pro-Russian separatists in Ukraine. In a hearing at the court in The Hague last June, Russia dismissed Ukraine’s allegations that it funded and controlled pro-Russian separatists in eastern Ukraine as fiction and “blatant lies”. The court dismissed all of the claims related to the Tatars but found Moscow did not do enough to support Ukrainian language education.

JOHANNESBURG (Reuters) - All states have an obligation to stop funding and facilitating Israel's military actions in Gaza after the World Court indicated that those actions could plausibly be genocidal, South African foreign minister Naledi Pandor said on Wednesday. The International Court of Justice (ICJ) last week ordered Israel to take all measures within its power to prevent its troops from committing genocide against Palestinians in Gaza, in a case brought by South Africa. South Africa has for decades been a strong advocate for the Palestinian cause, comparing the plight of Palestinians to that of Black South Africans under apartheid. KAMPALA (Reuters) - Uganda has distanced itself from an opinion written by a Ugandan judge on the International Court of Justice (ICJ) dissenting from the panel's ruling in South Africa's genocide case against Israel, and said the remarks do not reflect Uganda's position. "The position taken by Judge Sebutinde is her own individual and independent opinion, and does not in any way reflect the position of the government of the republic of Uganda," the government said in a statement issued late on Saturday. It added that the east African country supported the position of the Non-Aligned Movement on the conflict that was adopted at its summit in the Ugandan capital this month. The movement was formed officially in 1961 by countries opposed to joining either of the two major Cold War-era military and political blocs. Sebutinde was one of only two judges who issued dissenting judgements while 15 voted for the emergency measures which covered most of what South Africa had asked for in the case.
